74 - Death and Deadliness

 [ Death and the death penalty are discussed in terms of their effect or non-effect and their implementation.

 [ The ultimate legitimation of the end of life is the responsibility of the Great Carpenter, a powerful symbolization of the Dŕo.

 [ "The death penalty is an intervention in what is as it is 自然 zě rán (here: human life), that will take a bitter revenge [Simon p. 74].

 [ "Whoever wants to supplant the celestial messenger of death, loses his principles." [Héshŕng Gōng 河上公 / Erkes 1958 p. 126, 242].

 

 01-06:

 People, not afraid of death,

 how could one threaten them with death?

 

 If you cause people
 
fearing death continuously,

 and evildoers

 I would find and seize them...
 but
to execute them –

 who would dare?

 "Odd and uncommon [acts] to confuse the true [essence] [Laozi] calls '[committing] outrages.'" [* Wáng Bě / Wagner].

 01-02 "...how could they be frightened by [the threat] of death?" [*].

 "Experience teaches us how indifference to death can proliferate in such conditions, but, at the same time, crime increases, because the death threatened by the law and imposed by the judge is then no longer a deterrent for the people."  [** v. Strauß 1870 p. 321].

 03-06 "And, even if people could be made conti-nuously afraid of death, and one [, that is, a ruler, personally] would be able to consign those committing outrages to execution, who would there be to dare [to do theses executions]? [No one]."  [*].

 'Let him who is without sin cast the first stone.' [John 8:7].

 Note: Like here, can be treated as 'one', and it occurs in classical authors like Mengzi and others. [see Wagner 2003 p. 494].

 

 

 07-11:

 Always there were official executioners

 Yet, replacing them for executing

 means replacing the Great Carpenter

the Great Carpenter as cutter,

 hurt their hands, indeed!

 07 "[No one, because] there are always [people] handling executions who do the executing." [*].

 08-09 "It is a fact [, however,] that to replace [the people] handling executions at executing is replacing the Great Carpenter at cutting [wood]." [*].

 10-11 "It is a fact that few among those replacing the Great Carpenter at cutting will [get away] with their hands unharmed.
 
Those committing deviations will be loathed and resented by those going along; those who are not humane will be hated by those who are humane [and these other people will handle the execution of such villains automatically]. [*].

 "According to the Taoist view, the killing of a human - whether inside or outside the law - is an unnatural act that ultimately destroys the social structure, and the leader will harm himself if he assumes power that is anchored neither in himself nor in the organization.

 Any laws, restrictions, or punishments that inhibit the natural growth and independent development of human consciousness will destroy both the organization and its leaders." [Wing].

74 - Tod und Tödlichkeit

 [ Tod und Todesstrafe werden in ihrer Wirkung oder Nichtwirkung und bezüglich ihrer Durch-führung diskutiert.

 [ Die letzte Legitimation des Lebensendes obliegt dem Großen Zimmermann, einer mächtigen Versinnbildlichung des Dŕo.

 [ "Die Todesstrafe stelle einen Eingriff in das, was so st wie es ist 自然 zě rán (hier: das Menschenleben) dar, der sich bitter rächen werde [Simon p. 74].

 [ "Wer den himmlischen Todes(boten) verdrängen will, verliert seine Prinzipien." [Héshŕng Gōng 河上公 / Erkes 1958 p. 126, 242].

 

 01-06:

 Leute, die den Tod nicht fürchten,

 wie könnte man ihnen mit dem Tod drohen?

 

 Ließe man Leute ständig
 
den Tod fürchten,

 und Übeltäter –

 würde ich sie aufspüren und ergreifen...
 aber sie hinrichten –

 er wagte das?

 "Seltsames und ungewöhnliches [Handeln], um die wahre [Essenz] zu verwirren nennt [Laozi] 'Freveltaten begehen." [* Wáng Bě / Wagner].

 01-02 "... wie könnten sie sich vor [der Bedrohung] des Todes fürchten?" [*].

 "Die Erfahrung lehrt, wie bei solchen Zuständen die Gleichgültigkeit gegen den Tod um sich greifen kann, zugleich aber auch die Verbrechen zunehmen, weil dann der tod [sic!], den das Gesetz androht und der Richter verhängt, kein Schreckmittel mehr für das Volk ist." [** v. Strauß 1870 p. 321].

 03-06 "Und selbst wenn den Menschen ständig Angst vor dem Tod machen könnte, und einer [, das heißt, ein Herrscher, persönlich] wäre in der Lage, jene, die Freveltaten begehen, zur Hinrichtung zu übergeben, wer würde es wagen [diese Hinrichtungen durchzuführen]? [Niemand]." [*].

 'Wer ohne Schuld ist, der werfe den ersten Stein.' [Johannes 8:7].

 Anmerkung: kann, wie hier, als 'eins' behandelt werden und tritt bei klassischen Autoren wie Mengzi und anderen auf. [see * Wagner 2003 p. 494].

 Stets gab es amtliche Vollstrecker
 zum Hinrichten.

 Doch sie zu ersetzen zum Vollstrecken,

 hieße den Grossen Zimmermann
 
als unseren Schnitter zu ersetzen.

 

 Doch wahrlich: Ersetzten sie
 
den Großen Zimmermann als Schnitter,

 wohl selten hatten sie nicht
 ihre Hände verletzt!

 07 "[Niemand, weil] es immer [Leute] gibt, die Hinrichtungen handhaben, die die Ausführung besorgen." [*].

 08-09 "Es ist jedoch eine Tatsache, dass [die Leute], welche die Hinrichtungen durchführen, bei der Ausübung zu ersetzen, hieße, den 'Großen Zimmermann' beim Hacken [des Holzes] zu er-setzen." [*].

 10-11 "Es ist eine Tatsache, dass nur wenige unter denen, die den Großen Zimmermann beim Hacken ersetzen, mit ihren Händen unverletzt davonkom-men werden.
 Diejenigen, die Abweichungen begehen, werden von denen, die entlang gehen, gehasst und verachtet werden; jene, die nicht menschen-freundlich sind, werden von denjenigen gehasst werden, die menschlich sind [und diese anderen Leute werden die
Hinrichtung solcher Schurken automatisch handhaben]. [*].

 "Nach taoistischer Auffassung ist die Tötung eines Menschen – ob es nun innerhalb oder außhalb des Gesetzes erfolgt – ein unnatürlicher Akt, der letztendlich die Sozialstruktur zerstört. Ebenso wird der Führer sich selbst schaden, wenn er sich eine Machtbefugnis anmaßt, die weder in ihm selbst noch in der Organisaion verankert ist.

 Alle Gesetze, Restriktionen oder Strafen, die das natürliche Wachstsum und die unabhängige Entfaltung des menschlichen Bewussstseins hemmen, werden sowohl die Organisation wie auch ihre Führer vernichten." [Wing].

Etymological Notes:
